Terms of Service

These Terms of Service ("Terms") govern your access to and use of the GetPepWell platform, website, mobile applications, and all related services (collectively, the "Services") provided by GetPepWell, Inc. ("GetPepWell," "we," "us," or "our"). Please read these Terms carefully before using our Services.

Acceptance of Terms

By creating an account, accessing, or using our Services, you agree to be bound by these Terms, our Privacy Policy, and our Notice of Privacy Practices. If you do not agree to these Terms, you may not access or use the Services.

Eligibility

To use our Services, you must:

  • Be at least 18 years of age
  • Be a legal resident of the United States
  • Be located in a state where GetPepWell's telehealth services are available at the time of your consultation
  • Provide accurate, current, and complete information during registration
  • Have the legal capacity to enter into a binding agreement with GetPepWell

We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion if we determine that eligibility requirements are not met.

Account Registration and Security

When you create an account with GetPepWell, you agree to the following:

  • You will provide truthful, accurate, and complete registration information and keep it up to date
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account
  • You will notify us immediately of any unauthorized use of your account or any other security breach
  • You may not share your account with any other person or transfer your account without our prior written consent
  • We may suspend or terminate your account if we suspect unauthorized access or fraudulent activity

Telehealth Services

GetPepWell provides a technology platform that connects patients with licensed physicians for telehealth consultations related to peptide therapy. By using our telehealth services, you acknowledge and agree to the following:

Not Emergency Care

Our Services are not intended for medical emergencies. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately. GetPepWell is not a substitute for emergency medical services.

No Guarantees of Outcomes

While our physicians provide professional medical care, we cannot and do not guarantee specific health outcomes, the effectiveness of any prescribed treatment, or that our Services will meet your particular medical needs.

Physician Discretion

All medical decisions, including whether to prescribe medication, are made at the sole discretion of the treating physician. Physicians may decline to prescribe any medication or recommend alternative treatments based on their professional medical judgment.

Informed Consent

Before receiving telehealth services, you will be required to review and acknowledge our Informed Consent for Telehealth Services. You have the right to withdraw your consent at any time.

Accuracy of Information

You agree to provide complete and accurate health information during medical intake questionnaires and consultations. Providing false or misleading health information may result in inappropriate treatment and could endanger your health.

Prescriptions and Medications

Peptide therapies available through GetPepWell are prescription medications. By using our Services, you acknowledge and agree:

  • All medications require a valid prescription issued by a licensed physician following a telehealth consultation
  • You will not attempt to obtain medications without a valid prescription or use medications prescribed for another person
  • Medications are compounded and dispensed by licensed compounding pharmacies that are independent from GetPepWell
  • You will follow the prescribed dosage, administration instructions, and safety guidelines provided by your physician
  • You will promptly report any adverse reactions, side effects, or concerns to your treating physician
  • Some medications may not be available in all states due to regulatory restrictions

Subscription Plans and Billing

Available Plans

GetPepWell offers the following subscription tiers:

  • Starter (Free): Browse products, access educational content, and explore the platform
  • Monthly ($199/month): Full access to telehealth consultations, prescriptions, and all platform features
  • Quarterly ($149/month, billed at $447 per quarter): Full access with priority scheduling and discounted pricing

Recurring Charges

Paid subscriptions are billed automatically on a recurring basis (monthly or quarterly) using the payment method you provide. By subscribing, you authorize GetPepWell to charge your payment method at the beginning of each billing cycle until you cancel your subscription.

Price Changes

We reserve the right to adjust subscription pricing. We will provide at least 30 days notice before any price change takes effect. Continued use of the Services after a price change constitutes acceptance of the new pricing.

Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features through the end of your current billing period. No partial refunds are provided for unused portions of a billing period except as described in our Refund and Cancellation Policy.

Refunds and Cancellations

Our refund and cancellation practices are governed by our Refund and Cancellation Policy, which is incorporated into these Terms by reference. Please review that policy for details on eligibility, non-refundable items, and the refund request process.

Intellectual Property

All content, features, and functionality of the Services - including but not limited to text, graphics, logos, icons, images, software, and the overall design and arrangement - are owned by GetPepWell or its licensors and are protected by copyright, trademark, and other intellectual property laws.

  • You may not copy, reproduce, distribute, modify, create derivative works from, or publicly display any content from the Services without our prior written permission
  • The GetPepWell name, logo, and all related marks are trademarks of GetPepWell, Inc.
  • Medical content provided through the Services is for informational and treatment purposes only and may not be republished or redistributed

User Conduct

You agree not to use the Services to:

  • Provide false, misleading, or fraudulent information
  • Impersonate any person or entity, or misrepresent your affiliation
  • Attempt to gain unauthorized access to other user accounts, systems, or data
  • Interfere with or disrupt the Services, servers, or networks connected to the Services
  • Use the Services for any illegal purpose or in violation of any applicable law or regulation
  • Share, resell, or redistribute prescription medications obtained through the Services
  • Harass, abuse, or threaten any GetPepWell staff member, physician, or other user
  • Use automated means (bots, scrapers, crawlers) to access the Services without our written consent
  • Upload or transmit viruses, malware, or any other harmful code

Limitation of Liability

To the maximum extent permitted by applicable law, GetPepWell and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services, including but not limited to:

  • Loss of data, revenue, profits, or business opportunities
  • Personal injury or property damage resulting from your use of the Services
  • Any errors, omissions, or inaccuracies in content provided through the Services
  • Service interruptions, technical failures, or unauthorized access to your account

In no event shall our total liability to you for all claims arising from or related to the Services exceed the amount you have paid to GetPepWell in the twelve (12) months preceding the claim.

Nothing in these Terms limits liability that cannot be limited by law, including liability for gross negligence, willful misconduct, or fraud.

Indemnification

You agree to indemnify, defend, and hold harmless GetPepWell and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of or access to the Services
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Any information you provide through the Services that is false, misleading, or inaccurate
  • Your infringement of any third-party rights

Dispute Resolution

If a dispute arises between you and GetPepWell, we encourage you to first contact us at support@getpepwell.com to attempt to resolve the matter informally. If we are unable to resolve the dispute informally within 30 days, either party may pursue formal resolution.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services that cannot be resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in [State to be determined], and the arbitrator's decision shall be final and binding.

You agree that any dispute resolution proceedings will be conducted on an individual basis, and you waive any right to participate in a class action, class arbitration, or representative proceeding.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of [State to be determined], without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the federal or state courts located in [State to be determined].

Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and notify you via email or in-platform notification at least 30 days before the changes take effect. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the updated Terms.

If you do not agree with the updated Terms, you must stop using the Services and cancel your account before the changes take effect.
